Definitions

• Under ”Agreement“ term we mean the most current variant of the present terms and conditions of our dating service agreement

• Under “Licensed Materials” we mean our intellectual property including trade names and trademarks, logos and service mark as well as all content and photo information we have on our dating service website.

• Under “Service” we mean each and every website option we offer to our customers

• Under “website“ we mean vkagy.com

• ”IMBRA” stands for the International Marriage Broker Regulation Act of 2005 which consist in the Violence Against Women and the Department of Justice Reauthorization Act of 2005.

• Under “we”, ”us”, “our” we mean owners and administration of the vkagy.com dating service.

• Under “You,” “your,” and “yourself” we mean anyone who uses our service.


General Provisions

You are not allowed to use our services if you have not reached 18 years old.

Before using of any of our service, please, read, accept and agree with what is specified in the agreement.

Those are:

• The agreement takes affect after you access and starts use any service or tool we have on the website.

• The agreement contains all terms and conditions of your relations with our service and use of any our tool and service

• The agreement may only be changed or amended by the website administration, unless previously otherwise agreed in writing form with you.

• The agreement can be anytime amended by the website operators and takes full effect once it is posted on the website

• This agreement is the only agreement between you and our service and it terminates only under conditions provided herewith.

• Due to the nature of the service provided, vkagy.com does not guarantee you 100% dating success.


Membership

Membership with our dating service stipulates free registration of your user profile and free tariff selection possibility. Please, see the member tariffs options on the corresponding pages of the website.


Account Termination

Note: If instances of described below happen for the first time we do not terminate your account right forward, assuming that the violation could be done by mistake, so we just fine you. In case the violations continue, we terminate your account without extra warning.

The reasons for account termination are as follows:

• Spamming

• Personal info posting

• Uncensored content posting

• Pornographic nature photography posting


Refund Policy

We do not refund credits for the rendered services, unless an instance of bride scam detected and confirmed. In this case, the credits spent for the scam bride are transferred back to your account.

International Marriage Broker Regulation Act (IMBRA)

• If you are a U.S. inhabitant or resident looking to get personal information or meet in person non US inhabitants or residents, you hereby accept to fully agree with all provisions of the IMBRA, involving the requirement that you not directly contact with the non US inhabitants or residents before you have finished the procedures requested by the IMBRA.

• You agree and accept that your use of our Service is performed with full compliance with the IMBRA and the information notification as well as release requirements in particular

• After you completed all required by IMBRA requirements, we may put you in contact with a Facilitator to help you with background information note and provide requirements for you to be able to directly contact non US inhabitants and residents if needed.

• The Facilitator sends us and we make electronic copies of all the information provided, that is generally forms and documents you and the non US inhabitant have provided the Facilitator with for him to comply those with IMGRA requirements

• The Facilitator checks up US National and State Sex Offender lists.


Representations and warranties:

You agree to represent and warrant the following:

• The information you provide us and the Facilitator with is full, correct and if it changes you will update it within ten (10) days after it becomes incorrect;

• You will not either directly or indirectly violate legal rights of third parties or Intellectual Property (Licensed Materials) of our Website

• None of your agreements with us are involved in any kind of betrayal and none of the documents or data provided by you contain fraudulent or incorrect information.

• You have at least 18 years old, legally competent and not registered or convicted to be sex offender in any jurisdiction


Regarding the Website and our Services

• We distinctively invalidate all warranties, including those of merchantability and fitness for some particular purpose;

• We do not guarantee that our Website services will meet all your requirements;

• We do not make any guarantees or representations concerning use, accuracy or reliability of our Website;

You accept that:

• You use our Website and its Services at your own risk;

Breach, revocation and cancellation cases

If not otherwise specified, any violation of the Agreement by you must be cured within (5) calendar days after we send you a notification about that violation.

Such notification will be considered delivered when sent to your email address.

If you do not manage to cure the violation within the period given to you, we take back all our obligations from you and may stop your membership with our service, or look for other remedy available at law.

If not otherwise specified in this Agreement, notification about our actions in accordance with this Agreement will usually be delivered to you within fifteen (15) days after taking of the action.

In case you violate any provision of the Agreement, you accept that we can immediately stop your use of our Services and Website.

In case the violation made by you, we have right to post on the Website about you have violated our service terms and conditions.

In case we reveal that you have or keep on violating the Agreement or any jurisdiction law.

We have right to take civil and /or criminal actions towards you.

You will be subjected to legal, technical and administrative fees for damages caused by us for any violation of the Agreement.


Severability

In case that one or more provisions of the Agreement is turned unenforceable or invalid, the unaffected provisions of this Agreement shall continue be valid, and the invalid ones will be changed or replaced by a valid provision.


Limitation of Liability

You agree that we are not responsible for any harm or losses regarding any out of cases given below:

• Any act or fault made by you or your agent, with no regard authorized or unauthorized

• Your use or no use of our service

• Your communication (emails, gifts, contacting or trying to contact with) non US inhabitants or residents, no matter where are you or non US inhabitants or residents appear to be at the time, including the cases during trips made by you or non US inhabitant or resident

• Accurate, inaccurate or fraudulent both private and public information, provided by you or non US inhabitants or residents • Access problems to our service

• Events we cannot control, no matter if you or non US inhabitants or residents are compatible

• Your inability to pay us any fees

• Actions, orders and judgments of administrative, judicial and other governmental bodies.

We are not responsible for delays or inability to perform our obligations directly or indirectly resulted from causes which are beyond our control, such as: equipment break up, hardware or software failure, electrical power cut, hurricanes, floods, fires, storms, explosions, war, acts of God, labor disputes, strikes and riots, governmental actions, orders of courts and administrative bodies, or non performance of its liabilities by third parties.

We are not responsible for all kinds of direct and indirect damages, such as: incomes, goodwill, data use or other non material assets, whether in tort, contract or negligence, even if we are aware of such damages are possible and probable

If we got amenable to you by a competent court, the maximum liability we can be withdrawn is no more then $100.

We are not responsible for any damages or losses got during any domestic or international travel that you or any third party may take for any reasons. You solely bear all travel costs.

We do not guarantee or compensate any damages and loses that you may have while interaction with any person you can meet in through our website.

We are not responsible for any money or valuables that you can give to any third person.

We do not guarantee that any third person you can meet through our service want communicate with you. Everyone you meet through our website is free to stop communicating with you any time.

You agree indemnify and secure us concerning any damages or loses that you suffer during your communication with the person you meet through our website Indemnity You accept to defend, insure and indemnify and hold us as well as our users, employees, officers, affiliates and agents, not liable against any responsibilities, losses, damages or charges, all collection and attorney fees and court costs, related to any demand related to:

• Your use of the service

• Your communication or try to communicate or meet with non US inhabitants or residents

• You Violation of the agreement

• Incorrect or fraudulent information given by you or a non us inhabitant or resident you met through our website

• Termination of your membership or lowering of your membership level - Violation of any third party rights while use of our service
